Amendments underway for the RMA and Freshwater NPS
In an open letter penned by Hon. Minister Bishop, the Government has revealed its intentions to introduce significant amendments to the Resource Management Act (RMA) and the Freshwater National Policy Statement (NPS).

What is being proposed?
The forthcoming bill, being introduced on 7 March, proposes the concept of a "one-stop shop" designed to cut through the complexities of multiple legislations, including the RMA, MACAA (Common Marine and Coastal Area Act), Conservation Act, and Wildlife Act.
Key highlights of the proposed 'one-stop shop' approach include:
- Standalone Legislation: The new fast-track process will be encapsulated in a standalone Act featuring a distinct purpose statement. Drawing parallels to the previous Covid Process, this mechanism will expedite decision-making for locally, regionally, and nationally significant projects.
- Project Prioritisation: Notably, the fast-track process will prioritise infrastructure and development projects of significant scale, encompassing areas such as housing and critical infrastructure. A process will be established for the responsible minister to refer projects for acceptance into this streamlined pathway, including a predetermined list of projects earmarked for priority consideration.
- Expert Panel Oversight: Referred projects will undergo scrutiny by an Expert Panel tasked with assessing the proposed developments and imposing necessary conditions to mitigate adverse effects. While the Expert Panel will possess limited discretion to decline projects once referred, its primary objective will be to ensure effective management of potential negative impacts.
Furthermore, there will likely be an interim approach for decision-making on Freshwater NPS that incorporates the hierarchy of obligations under Te Mana o Te Wai.
